Secondhand Dealers and Secondary Metals RecyclersFlorida law (Chapter 538, Florida Statutes) requires businesses that sell secondhand goods such as used CDs, household furniture, and jewelry to register as a secondhand dealer and to comply with record keeping and holding period requirements. Persons or entities that conduct business in Florida who contract with others to buy precious metals or jewelry through an Internet website, the United States mail, or telemarketing; or conduct business in Florida and regularly engage in the business of purchasing jewelry or precious metals through the mail or Internet-based transactions, must register as a mail-in secondhand dealer. Salvage, scrap metal, and recycling center businesses must register as a secondary metals recycler and comply with record keeping and holding period requirements. Local law enforcement – Enforcement and oversight of registration and recordkeeping requirements: Local law enforcement is responsible for enforcing secondhand dealer, mail-in secondhand dealer, and secondary metals recycler compliance with registration, recordkeeping, holding period, and inspection requirements.
